It doesn't make a difference what the card is called. If he opened an account without their knowledge OR if he used that card for non-business items, yes, AMEX might get a judgement against both but Dreams can easily cross claim against Pete.
And, the complaint names both the corporation, AND Werner as co-defendants, jointly and severally liable. AmEX must have crappy lawyers too. Probably have zero idea who opened the account, have no records of the application, the charges, payment history, etc.

There's a thread up on the DIS boards about the new studio and people are vaguely commenting on what's going on. Let's see how long it's going to be allowed to be up.

Need to catch up but I just wanna pop up to say I just grabbed a title so we could move on with a new thread. Personally I have never enjoyed Pete on any of the shows and I have been watching for a long long time. I have always seen that’s he’s a narcissist and an asshole and while I don’t wish death on him (ie “demise”) I do think his time is done and I want the whole team to be able to move on and for Sean and Dustin and any other victim of his physical and emotional abuse to have their day and some sort of closure.

I also suffer from anxiety and depression (I had pretty severe ppd/anxiety too) and it’s not an excuse or get out of jail free card for your behavior. Also the daughter of a narcissist who went no contact years ago. A leopard doesn’t change their spots.
 
You don't get to make these sorts of connections walking around in walmart slacks and fruit of the loom t-shirts:

But wrinkly shirts and jeans are just fine. Or, that $40 Under Armour polo Werner is wearing..
 
As was already said, Pete is the owner and CEO of Dreams. I don't know how you make the argument he opened the card without company approval when he is the company. There is no board above him he reports to.

What the really remarkable thing here is that Dreams asserted that defense! It’s a clear indication of their business relationship (as if the moving of the studio wasn’t enough).
 
Lawyer reporting in again: Because there were some armchair lawyers in the thread I spoke to a friend who does credit card debt defense (in Orlando no less) and forwarded him the Pete/Dreams lawsuit. I also let him know Dreams is trying to claim Pete lacked authority to sign up for the card.

Co-counsel’s response: “My first thought: I don’t see how as high a level executive such as the CEO could not have the apparent authority to the card issuer/bank to be able to do something like that. Like the guy is running the business, any bank would assume it’s within the bounds of their authority.

Second, if you take a look at the Cardmember Agreement there is a clear promise to pay on both defendant’s parts because “you” in the Cardmember Agreement is defined as “Cardmember” and “Company” which in this case is “Peter Werner” and “Dreams Unlimited Tra”. The defendants agreed to be joint and severally liable here. I won’t comment on the other affirmative defenses raised by the defendants because they haven’t provided any evidence, not that you would expect that in an answer and affirmative defenses anyway.”

He had choice words for Amex’s firm which I’ll omit 😂

I will add to this. I believe Pete has had a platinum card with Amex with Dreams for a very long time (if not then it’s just his personal card and Dreams pays the bill which I guess is a different problem). So if he then also got a Gold card with Amex, I don’t really see how Amex would even question that as the CEO of the company, who already has an open account with them would get another card under the same company name.

The only thing is I can think of is if they always had a policy of all three owners approval to open any new accounts. The other interesting thing is the amount of times Pete saying on the show how John figures out the financial arrangements of anything they want to do. He always gave credit to John handling everything financial to keep things running for the company. I know this has no bearing on the legality of getting the card, just pointing out how little Pete was involved in this aspect.

Additional free gold cards are a benefit of the platinum card. They connect to the original account so maybe the argument is he didnt have permission to get the gold card under the existing dreams account.
