Any of these much smaller creators could argue the Trackers much larger audience could diminish the demand for the original videos. Now there might be a caveat here if enough people click through in the links in the Tracker's video to watch the originals they could prove they are helping the channels they took video clips from vs harming them.
My annoyance is with the utter cheek of attacking someone online, cutting him out your life, posting borderline racist gifs about him then stealing his footage. They have zero moral standards or boundaries. They won't collaborate with other vloggers, when they do hang out they show others sparingly. Now they need these others they just carry on blatantly. Is this a sign of desperation? We can only hope....
In my head I'm comparing their use of other vlogger's footage to a news channel using a competitor's news footage of the same event they're reporting on. That is something that very, very rarely happens outside of extreme circumstances (like one news channel capturing footage of something no one else was able to capture, and in that case I'm sure the competing channel obtains explicit permission to use the footage).
The Trackers specifically used video footage captured by their competitors likely without obtaining permission thinking the fair use act protects them. However, the fair use act is purposefully ambiguous and doesn't lay out very clear rules, so it could happen that one of the other vloggers reports them and has the video taken down until the footage is removed. Especially since they used footage from competing channels for their own profit.
Tim quizzing the guide on "fun facts" was so rude. He needs to make it known how much he knows and how little everyone else knows.
I think Jenn going in the haunted houses was extremely stupid. I googled it and it seems roughly 50-50 in terms of what people's doctors' recommended they do, but why risk it? She admits she was "startled" a number of times. She could have easily fallen over and obviously you don't want that when pregnant.
All that said, I skipped 99% of the video. As someone not going to HHN...watching clips from other vloggers followed by *Tim&Jenn React* is extremely dull.

Links that nobody is going to use because they are buried under a pile of their own video links followed by a shitload of camera shopping links. Who's gonna scroll down that far? I soooooo hope the other vloggers make some sort of stink about this.

I would be so bleeping pissed if I was one of those vloggers. So they don’t even ask? Just slap a Fair Use label on it? Have some balls and ask first you assholes.

Yeah you can’t film in the houses at Orlando. They couldn’t last year and used footage from Ordinary Adventures. Wouldn’t be surprised if they did the same thing this year.
So they buried the info re: stealing from other vloggers as the last thing in the description (even after the affiliate links)...that NONE of their stans are going to scroll down enough to see.
AND could they make the font any smaller giving credit to the ones they stole from? The average viewer isn't probably even going to notice this!
As well as the other vloggers, I wonder what Universal's response is to them using house footage in their video after being removed from the media list?!
I don't know what I was expecting but a tiny part of me was hoping they were going to give a shout out the channels whose footage they used at the end of the video. The credits on each clip seemed passive-aggressively small on my computer screen. (EDIT: @2020planner, I just saw your comment on the same thing, I'm so glad it wasn't just me!) All they had to do was say "check out our description for links to the footage we used in this video." They even could've done it in place of the "and now it's time to pay the price" with that TERRIBLE audio. Their lack of grace to other vloggers is so noticeable with things like this.
Also, I really felt like "scream squad" is the Halloween version of "the world is our palm tree". Repeating something 300 times in one video is not going to make it a catchphrase. I'd love to know if their tour guide really still found that funny by the end of the night.
trackers can't curate other channel's comments. simply asking "did the trackers ask if they could use your footage?" in the comments of their videos could be interesting.
I can't believe they've done this. They obviously haven't asked permission that's why they've claimed 'Fair Use'. If they had asked they would have just said thanks.
Also interesting to note that OA obviously told them to F Off this year as last year they handed over all of their house footage for the trackholes to use.
One things for certain, after this stunt there's no way they can come after FRE for anything.
Maybe "kill them with kindness" and post something on the other channels like "So nice of you to let the Trackers use your footage even though their channel is far larger than yours and now people are less likely to watch your HHN video."

I'm sure that poor tour guide appreciated the camera so close to her face that you can see the gum in her mouth. Gross.
I wonder who the other 8 people were in their private tour and how they managed to have enough composure not to throat punch Tim for trying to show off his HHN trivia any chance he could get. Annoying AF.
