she is forced to plead not guilty, if she doesnt she pretty much has no chance to get any custody

the code makes a big deal out of the fact that physical injury is where the bigger punishments are applied. I think she'll get away with a fine, but obviously if she keep breeching it she wont avoid it.
She will be found guilty no matter what. The evidence is all in her own writing, she handed it all over to the public on a social media platform. Her chances at any custody are slim as it is because seems she is not playing ball with the arrangements as they are anyway. The judge will happily take the kids at this point. Her only real chance with the kids is to stop interfering with the kids, stop the PA and do as she is told from now on.

By the way, 273.6 (A) falls under Chapter 2: Abandonment and Neglect of Children

:(
No, it’s a violation of a protective order.

California Penal Code [CPC] §273.6(a) – Violation of Court Order - California Penal Code §273.6(a) makes it illegal to violate any “protective order” as defined under one of five sections of state law. Failure to follow the terms of a protective order can result in arrest and prosecution.

Lest we forget...here's our Graham with a quick reminder! (will make sense to this from UKI of a certain age. And yes, I know its the wrong Graham 😅)

you will have to try tbh, I mean even if all her evidence is in writing, if she is lucky the judge will not agree with the prosecution that this is enough to see a breech (I mean clearly, he will, alone the fact that she admits it herself in the tweets that she knows she is breeching the RO clears pretty much the biggest hurdle)

Stupid question: can she ask for a jury trial? I could see her thinking that she can reach people with a few crocodile tears.

Firearms?????
it doesnt apply to this case, just that all these protective orders are covered over this section.

The only way the judge would dismiss the charges is if he/she felt there wasn’t enough evidence but it’s really rare that this happens. A jury trial is an option if you are facing jail time.

I agree she is pretty much going to have to plead not guilty in the hopes she isn’t convicted (she likely will be though), if only because of the repercussions on her spousal support and custody.

Sorry yes you are correct! Lower case (a). I'll try to get mods to delete my posts. 😵
