Urghhh!
Just got an email from our solicitor about fixtures and fittings from our buyer.
Basically we had originally said we would leave the washing machine however it broke and we had to replace it.
I informed our solicitor and buyer that we would no longer be leaving it due to it breaking and was informed that they have a second hand one so it wouldn't be an issue.
Now they have emailed their solicitor complaining about it.
I'm not sure where we stand with this as, whilst it was included in the fixtures and fittings, we have written messages saying it isn't a problem that it isn't being left.
Tell them you'll leave the original, broken one if they wish

If you haven't yet exchanged then you are within your rights to change your mind about leaving any specific items you'd previously said you'd leave.

It would be different if you had exchanged and then failed to leave the item on completion as you'd be breaching the contract. However, until exchange it's not binding.

We have completed, we completed on 20th. However we advised our solicitor on 9th November that we would no longer be leaving the washing machine. Simply because it had completely broken and we were told by our buyer, in writing, that they had a spare so not to worry.

We informed our solicitor early so if there were legal ramifications, we could get those sorted prior to completion. We were never told of any issues, just that she'd informed their solicitor

If they confirmed via email that they were happy with that then I don’t think they have a leg to stand on to be honest, especially since you’ve completed

When did you exchange, assuming after informing your solicitor on 9th?

If you've got it in writing that the buyers were aware it wouldn't be left, and they were fine about it I wouldn't worry too much.

Weird that they'd complain about something they were fully aware of. Keep copies of any correspondence between you, the buyer and your solicitor in case the buyer tries to take it further but if it's in writing as you say that they were aware then I wouldn't worry.

We exchanged on 14 December. So they had a good month to let us know they weren't happy. But, like you said, we informed them before exchange so I'm not sure if we're legally entitled to leave it? I made sure to inform our solicitor in good time just so they were aware and if we needed to do anything we had time. Didn't hear anything from their solicitor after ours had informed them.

We also reminded them the week before completion and received another message saying that it was fine and they had a spare. They asked if the washing machine would be in the house and I said no cos it had broken. So I'm not sure what is going on. 🤷‍♀️

The cost of them trying to go through the legal process of getting a washing machine would cost more than just buying one surely? They’re just trying their luck

You'd only be legally obliged to leave it if you had already exchanged and it was agreed during exchange that it would be left.

You advised them long before exchange. As another person said, they're trying their luck but the expense of pursuing this won't be worth it for them and you have evidence that they knew. Just keep copies of your correspondence with them evidencing that they were fully aware it wouldn't be left.

Just ignore them.

I still don't have my curtain poles that were meant to be left (genuinely) and I think they've just started ignoring the solicitors lol

Honestly, this whole process has been such a stress, I thought once we were completed I'd be left alone 😅🤣

I've just had another email and now apparently the oven isn't working and they're mad about that.

I have no idea what's happened there but we used that the morning of the move so I have no clue. 🙃

They just sound like nightmare buyers tbh.

If the oven wasn't working on the day of completion, then they'd have a right to complain. Weeks later? Absolutely not.

Ignore them.

Not sure why your solicitor is even entertaining that particular moan from them.

It's frustrating cos we left a lot of stuff and dropped our asking price for them.

Apparently the oven has been tripping the electricity every time they turn it on.

This has never happened with us so I've got no clue what the problem is 🤷‍♀️ only thing I can think is they've got something plugged in that is tripping it but the oven is causing the trip.

leave the old broken one behind and take your new one with you

Did your Solicitor not write a clause in the contract stating that although appliances were being left there would be no guarantee regarding them,
 
It's your house now, rock up on the doorstep and kick them out. They're supposed to give vacant possession on completion.

we decided to bite the bullet and make the journey. The estate agent called whilst I was on the way to say I could pick up the keys so luckily didn’t come down to that!

my only question now - they’ve left their curtains behind. They weren’t on our F&F list and so we assumed we would have to get our own - should we tell our solicitor?

Leave them up for now, at least it gives you something on the windows, if they come round at some point demanding them, hand them over, but for now, I'd leave it.
