There is a massive difference between having her living with Louise permanently and not spending time with Matt at all. Even if she goes every second weekend she would be considered staying with Louise 100%. This also wouldn’t equal to her having single custody. But it most definitely means that Louise (and Liam) make 99.9% of the general parenting decisions.
I don’t think we can conclude that she isn’t spending time with her Dad anymore. At 13 she is probably sick of moving back and forth. If she feels serious about her theatre stuff and wants to spend some time with peers it’s certainly more convenient to life with in a two parent household where your parent doesn’t have fixed work times and there is a second adult to cover. She is old enough that her preference will be followed by a judge if there aren’t any big objectives. Her relationship to her Dad should be secure enough that it will be fine. But I can see him not agreeing to change of living arrangements straight away, hence dragging it to court. If he is divorcing that’s definitely a big life change maybe even with the need to move, so not exactly working in his favour.
