Most swipe ups are affiliate programs (for commission) which are generally subject to looser rules (by the company) because you make pennies on them. However, they still need to be declared as adverts on insta or they're breaking ASA rules!

Shirl, so I’ve noticed that truff never has (or very rarely, I’ve never seen it) that “paid partnership” statement under her name on her Insta stories - does that mean she’s not getting paid then? I know we see the odd tiny #ad in the corner but it’s mainly BA / brand ambassador on her stories. So I’m thinking either she’s not getting paid and lives off freebies, or she is getting paid and not declaring it properly - and therefore a case for the ASA. I remember months and months ago on the hinch thread that someone found out hinch gets paid tens of thousands for a paid partnership - don’t know how true that is though...

I know I'm totally boring about this but you don't have to be paid for it to have to declare it as an #ad. Anything given to you for free (or even loaned for free) is an #ad in the ASA'S eyes. You have to declare ANYTHING you didn't pay for, giveaways, your own brand, anything. The problem for an influencer is that Instagram doesn't like #ads and likes #paidpartnership even less and the algorithm affects reach hugely. Hence why people like Truff fail to declare.
Please do complain if this bugs you. The ASA regularly calls Grammers out for this.

There's a chance she's doing it and not declaring it, but no proper company would put out a contract without it. When that partnership feature is showing, it means the company can have direct access to the analytics on that post. Rare for a big brand to collaborate without access ot the data.

Yeah I had a little look through her Insta grid posts and she does state ad but not #ad - so by leaving out the # she thinks she’s declaring it without messing up her reach. Thank you for the insights, more needs to be done to call out these grammers. I know hinch was getting LOADS of complaints, and rightly so if what she was getting paid is true. Like many of you have said - they’ve got one job to do

I phoned the police and they went to look for her.
