It depends. The local authority I work for only allows one succession of the tenancy to someone who has been living at the address. So, for example, if a couple have a joint tenancy and one passes away, the tenancy transfers to the surviving spouse/partner as a sole tenancy. And that's the one succession allowed. Also, LA's and Housing Associations have differing policies on under occupancy.

Yeah it's pretty much standard practice. There are some different types of tenancy where it may be slightly different, but they aren't standard. Plus, if it's a sole tenancy in one of a couples name, and that person passes away, it's really only the surviving partner that can succeed the tenancy. I don't think she'll end up with the house either. And nor should she!
