In court terms, indefinite means order support without a time limit at the time it is made. The support may last until the receiving spouse becomes self-supporting, dies, or remarries. So, what is the Rule of 65 in spousal support?

10 Year Marriage Rule
For marriages of less than 10 years, support is typically granted for half the length of the marriage. But for marriages of 10 years or more, they are often considered "lengthy" or "long-term" and the court may not set a definite termination date for spousal support.
Rule of 65
Rule of 65 applies if the age of the recipient at the time of divorce plus the number of years they were married equals or is more than 65. If this is the case, spousal support may be paid indefinitely, even if the marriage was less than 10 years.

The judge will consider and evaluate the following factors when determining spousal support:

  • Marketable skills of the supported spouse.
  • Age and health of both spouses.
  • Time and expense needed for the supported spouse to acquire education or skills for employment.
  • The paying spouse’s ability to pay support.
  • The length of the marriage.
  • Assets and debt obligations of both spouses.
  • Tax implications for each spouse.
  • Standard of living established during the marriage.

I don’t think anyone could have read Alice’s treasure trove of lies over the years, watched this custody situation play out, and not been desperately sad for those girls. And very angry at someone who just seems to keep skating through the nastiness she dishes out. That’s how I feel. She may have a lot of problems. That does not give her the right to inflict them on everyone around her.

you still dont understand me. No, Alice doesnt qualify for it due to this, because she already qualifies over having a 10+ marriage. They set the exact same terms: the support is indefinite (no end date defined as opposite to shorter marriages), but generally the courts do terminate it after some time if someone asks for it (notice the "may"). Again, rule 65 was invented for woman that get dumped in their 60s/70s but dont qualify for indefinite (long term) support due to the marriage length. So, again, it makes no difference. She had this aspect already in the bag in 2017 when they completed 10 years of marriage, but indefinite support doesnt mean lifetime support, that's a urban myth.

This rule doesn't apply in cases, as here, where there is a prenup because the prenup determines what spousal support is paid rather than leaving it up to the judge (as in cases without premarital agreements). Of course, the judge can modify support if the prenup is ruled to be invalid or insufficient, but Ioan has overpaid so much that I don't see this happening.

I'm about to dive into the filing (those who are about to die salute you) 💀😂
